As state-mandated Paid Leave programs continue to get adopted across the United States in various forms, it may feel increasingly difficult to keep up with the varying details of each state. So, this handy tool helps you compare the details at-a-glance for statutory benefit programs that are available as private coverage through ShelterPoint.

Statutory Benefit Programs in Context

Statutory short-term disability insurance paved the way

A handful of states have had mandated Short-Term Disability and/or Paid Family Leave programs in place for some time, going as far back as the 1940s for statutory short-term disability insurance.

  • NY and NJ, as states you can select in the comparison chart above, are 2 of the early leaders that started with just statutory short-term disability for non-occupational disabilities.
  • They have since added Paid Family Leave as a separate statutory benefit.
    • In essence they now provide the same forms of coverage as more recent Paid Family & Medical Leave (PFML) states via 2 separate laws/programs in those states.
    • For these states, the mandated short-term disability program is comparable to the self-care “medical leave” portion of PFML.
    • Please note: while ShelterPoint provides coverage for New Jersey's version of statutory short-term disability insurance, we currently don’t offer New Jersey’s version of Paid Family Leave.

The rise of Paid Family & Medical Leave (PFML) programs

More recently, Paid Family & Medical Leave (PFML) is becoming a required benefit in an increasing number of states in the US. These newer state programs provide family leave as part of a benefit program that includes both the Family Leave portion (for example, to bond with a new baby or care for a sick loved one) AND a self-care component that provides benefits if the covered employee is out of work due to a non-occupational sickness/injury.

Whether an employer chooses to obtain this insurance coverage through the state or from a private carrier, it provides partially-paid time-off for certain family and/or medical reasons.
